ARTICLE VII ELECTION – VOTE
CHƯƠNG VII
TỔ CHỨC BẦU CỬ – PHIẾU BẦU
17.1.- At least 90 days prior to the day the Community Executive Board or the Community Advisory Council reaches its terms of office, the Advisory Council shall organize an Election Commission composed of at least 5 people. Members of the Election Commission are to be selected among VNCO’s members, except those who are members of the current Community Executive Board and current Community Advisory Council. Also, members of the Election Commission shall not be eligible to run for any position in the Community Executive Board and the Community Advisory Council.
17.1.- Trong thời hạn ít nhất là 90 ngày trước ngày BCH/CĐ và Ban Cố vấn đương kim mãn nhiệm, Ban Cố Vấn của Cộng Đồng có trách nhiệm đề cử một “BAN VẬN ĐỘNG VÀ TỔ CHỨC BẦU CỬ” gồm ít nhất là 5 vị. Các ủy viên trong Ban Vận Động và Tổ Chức Bầu Cử được chọn trong số thành viên chính thức của Cộng Đồng, ngoại trừ những người hiện là ủy viên Ban Chấp Hành và Ban Cố vấn đương kim. Các ủy viên trong Ban Vận động và Tổ Chức Bầu cử cũng không được quyền ứng cử vào Ban Chấp Hành Cộng Đồng và Ban Cố vấn Cộng Đồng.
17.2.- The Election Commission shall be responsible to set the date and location for the election, besides, it shall notify all VNCO’s members of the election and organize campaigns to mobilize VNCO’s members to participate in the election. The date of election shall be set around 1 or 2 months before the day the Executive Board or the Advisory Council reaches their terms.
17.2.- Ban Vận Động và Tổ Chức Bầu Cử ấn định ngày và địa điểm bầu cử, ngoài ra có trách nhiệm thông báo cho toàn thể Cộng đồng người Việt tại Oregon biết về việc bầu cử Ban Chấp Hành và Ban Cố vấn Cộng Đồng, đồng thời vận động cộng đồng tham gia việc ứng cử và bầu cử. Ngày bầu cử phải được ấn định trong khoảng thời gian từ 1 đến 2 tháng trước ngày BCH hay Ban Cố vấn đương kim mãn nhiệm kỳ.
17.3.- At least 30 days before the election, the Election Commission shall present the list of candidates to the Community Advisory Council, and shall use all means available to keep all VNCO’s members aware of it.
17.3.- Ít nhất 30 ngày trước ngày bầu cử Ban Vận Động và Tổ Chức Bầu Cử phải trình cho Ban Cố Vấn danh sách các ứng cử viên và niêm yết danh sách này cho toàn thể đồng hương trong Cộng Đồng rõ.
Section 18: Running for members of the Community Executive Board or Community Advisory Council.
Điều 18: Ứng cử vào Ban Chấp Hành và Ban Cố vấn Cộng Đồng-
18.1.- All members of VNCO who agree and abide to Article I of this Bylaw, have been residing in Oregon at least two years, have not been convicted of any legal offense, and have had no bad reputation in social relationships are eligible to run for a position in VNCO’s Executive Board and Advisory Council. All members who run for the President of the Community of Executive Board, the Leader of slay, or the President of the Community of Advisory have been residing in Oregon at least 5 years from the day they submit the application form from the Election Commission.
18.1-. Những thành viên của Cộng Đồng chấp nhận và tuân hành Chương I của bản nội quy này, đã và đang cư ngụ tại Oregon ít nhất 2 năm, không can án, và không có thành tích xấu trong quan hệ xã hội đều có quyền ứng cử vào Ban Chấp Hành và Ban Cố Vấn CĐVN/OR. Tuy nhiên những vị nộp đơn cho các chức vụ Chủ Tịch Cộng Đồng, Thụ Uỷ Liên danh, hay chức vụ Trưởng Ban Cố Vấn Cộng Đồng phải sinh sống liên tục 5 năm kể từ ngày nộp đơn với Ban Vận Động và Tổ Chức Bầu Cử.
18.2.– The procedures to run for positions in the Community Executive Board and Community Advisory Council are determined as follows:
a) Running as a slate or individually.
b) Nominating as a slate or individually.
18.2. Thể thức ứng cử vào Ban Chấp Hành Cộng Đồng và Ban Cố vấn Cộng Đồng được tiến hành dưới 2 hình thức :
a) Ứng cử liên danh hoặc đơn danh. b) Đề cử liên danh hoặc đơn danh.
18.3.- Running or nominated as a slate:
Whether a slate is running by itself or by nomination, the slate should have a slate leader; this leader would become President of the Community Executive Board or Chairperson of the Community Advisory Council if this slate is confirmed to have the highest number of votes in the election.
18.3.- Ứng cử hoặc Đề cử liên danh:
Dù ứng cử hay được đề cử, liên danh tham dự cuộc bầu cử phải có một người thụ ủy, người thụ ủy liên danh sẽ đương nhiên trở thành Chủ Tịch Ban Chấp Hành Cộng Đồng hay Trưởng Ban Cố vấn Cộng đồng nếu liên danh liên hệ được xác nhận có số phiếu tối đa trong cuộc bầu cử.
18.4.- Running individually or by nomination
In case the candidate is running individually or if there is only one nominated candidate, and if this candidate is the winner in the election, he/she shall be responsible to select enough members to fill out the needed positions for the Community Executive Board or the Community Advisory Council as determined by this Bylaw. He /she shall be also responsible for the behavior of the selected people.
18.4. Ứng cử hoặc đề cử đơn danh:
Trường hợp ứng cử hay đề cử đơn danh, nêu trúng cử, ứng cử viên liên hệ có trách nhiệm chọn đủ thành viên cho Ban Chấp Hành Cộng Đồng hay Ban Cố vấn, và trực tiếp chịu trách nhiệm về tư cách phục vụ của những thành viên này.
Điều 19: BẦU CỬ
Section 19: ELECTION
19.1.- All members of Vietnamese descent 18 years and older, residing in Oregon at least one year are eligible to participate in the election to elect the Community Executive Board and the Community Advisory Council.
19.1. Tất cả người Việt Nam từ 18 tuổi trở lên và đã và đang cư ngụ tại Oregon ít nhất 1 năm đều có quyền tham gia bầu cử để chọn Ban Chấp Hành Cộng Đồng và Ban Cố vấn.
19.2.- All elections shall be conducted in public, direct, and secret process.
19.2-. Các cuộc bầu cử đều được áp dụng theo thể thức phổ thông đầu phiếu, trực tiếp, và kín.
19.3.- The Election Commission shall make the vote count and announce the election result right on the election day. The candidate or slate who gathers the highest number of votes is considered winner. In case two individuals or two slates have the same number of votes, the Election Commission shall have to report to the Community Executive Board to call for an Irregular General Assembly to solve the problem.
19.3. Ban Vận Động và Tổ Chức Bầu Cử sẽ kiểm phiếu và tuyên bố kết quả trong ngày. Liên danh ứng cử hay ứng cử viên nào có số phiếu cao nhất sẽ đắc cử. Trường hợp 2 liên danh hay ứng cử viên có đồng phiếu, Ban Vận động và Tổ chức bầu cử phải trình cho Ban Chấp Hành Cộng đồng đương nhiệm để triệu tập Đại Hội Cộng Đồng bất thường quyết định.
19.4.- In case there is only one candidate or one slate participating in the election, the election should take place anyway. If the candidate or slate has at least 60% of the total votes in the election, he/she shall be the winner. In case, this candidate or slate could not get at least 60% of the total votes, the Election Commission should call for another election and keep doing so until the President of the Community Executive Board or the Chairperson of the Community Advisory Council is elected.
19.4. Nếu chỉ có một liên danh ứng cử hay một cá nhân ứng cử mà thôi, Ban Vận Động và Tổ Chức Bầu Cử vẫn xúc tiến tổ chức bầu cử . Nếu liên danh hay ứng cử viên liên hệ đạt được ít nhất 60% tổng số phiếu bầu, liên danh hay ứng cử viên ấy sẽ đắc cử. Trường hợp Liên danh hay ứng cử viên liên hệ không đạt được 60% tổng số phiếu bầu, Ban Vận Động và Tổ Chức Bầu Cử phải tiếp tục vận động để tái tổ chức cuộc bầu cử cho đến khi bầu được một Chủ Tịch Cộng Đồng hay Trưởng Ban Cố vấn Cộng Đồng.
19.5.– The time and location of the election shall be decided by the Election Commission. Information related to the election should be notified to all members of the Community at least 30 days before the election day.
19.5. Thời gian và địa điểm bầu cử do Ban Vận Động và Tổ Chức Bầu Cử quyết định. Ngày giờ và địa điểm bầu cử phải được thông báo rộng rải cho đồng bào ít nhất 30 ngày trước ngày bầu cử.
